Dear Mr. Brown:
You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID # 121625.
The City of Dallas Police Department (the "department") received a request for all records in reference to a police officer, including the police officer's home address. The department released all the requested information except for the home address of the police officer. You claim that the home address of the police officer should be withheld pursuant to section 552.117 of the Texas Government Code. We have considered the exception you claim and have reviewed the document submitted.
We address your assertion that some of the requested information is excepted from required public disclosure under section 552.117(2) of the Government Code. Section 552.117(2) requires that the department withhold its peace officers' home addresses, telephone numbers, and social security numbers, and information that reveals whether the peace officer has family members. Assuming that the individual to whom the request relates is a peace officer as defined by Article 2.12, Code of Criminal Procedure, the department must withhold the home address of one of its members pursuant to section 552.117(2).
We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records.
