Dear Ms. Johnson:

You ask whether certain information is subject to required public disclosure under the Texas Open Records Act, chapter 552 of the Government Code. Your request was assigned ID# 122987.

The City of Blue Mound (the "city") received a request for various categories of documents. You state that the city has no documents responsive to items 2, 3, 4, and 6 of the request. You claim that information relating to the Tandy property easement is excepted from disclosure under section 552.103 of the Government Code.

We note that the submitted documents were previously addressed in Open Records Letter No. 99-0068 (1999). You state that in accordance with that letter ruling you have provided the requestor with certain responsive documents. Because the only documents at issue have been previously addressed under section 552.103, and you do not indicate that litigation has concluded, we need not further address these documents at this time.

We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied on as a previous determination regarding any other records. If you have any questions regarding this ruling, please contact our office.
