Office of the General Counsel
Texas Department of Criminal Justice

Dear Ms. Grimes:

You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 123306.

The Texas Department of Criminal Justice ("TDCJ") received a request for a copy of a violation report with respect to a named "releasee." You seek to withhold the requested information under sections 552.101 and 552.111 of the Government Code.

Section 552.101 requires withholding, inter alia, information made confidential by statute. Section 508.313(a)(2) of the Government Code makes confidential, with exceptions which do not apply here, all information obtained and maintained by the pardons and paroles division of TDCJ relating to a "releasee." You advise that the information at issue was obtained and maintained by the pardons and paroles division. In our opinion, the requested information is protected in its entirety under section 508.313. Since we have resolved this matter under section 508.313, we need not address your other claims.

We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records. If you have questions about this ruling, please contact our office.

William Walker
Assistant Attorney General
