Dear Mr. Simpson:
You have asked whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 125724.
The Veteran's Land Board (the "VLB") received a request for certain application contracts, a copy of a file, and complaints concerning a particular developer.(1) It is our understanding that most of the information requested was provided to the requestor. However, you assert that one document, which was submitted to this office for review, is in part protected from disclosure under section 552.107(1) of the Government Code. Section 552.107(1) protects from disclosure information that reveals client confidences to an attorney or that reveals the attorney's legal advice, opinion, and recommendation. See Open Records Decision No. 574 (1990). We agree that section 552.107(1) excepts from disclosure the last two paragraphs of the memorandum dated March 17, 1997.
We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records. 1. We note that the original request was received on April 1, 1999, but you indicate that the requestor modified her request on April 9 to the documents indicated above.
