Dear Mr. Davis:

You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 125845.

The City of Fort Worth received a request for a certain bid proposal submitted by IT Nexus. You asked on behalf of IT Nexus whether the responsive information was subject to withholding from disclosure as a trade secret or under section 552.104 of the Government Code. Pursuant to section 552.305 of the Government Code, this office notified IT Nexus on May 10, 1999 of the request, advising that if it objected to release of the requested information it should submit reasons to this office why the information should be withheld within fourteen days of its receipt of the notification. To date, IT Nexus has not submitted any arguments as to why the requested information should be withheld. Therefore, we have no basis for finding that the requested information should be withheld. Thus, you must release the requested bid proposal.

We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records. If you have questions about this ruling, please contact our office.
