Dear Mr. Whittenton:

You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 129125.

The Bastrop County Sheriff's Department (the "department") received a request for a prisoner roster, including names, identification numbers, housing addresses, charges pending, and information as to whether there is an INS hold on the detainee. Open Records Letter No. 99-2064 (1999) addressed a request by the same requestor for this same information. That ruling found that the information the department sought to withhold was made confidential under section 552.101 of the Government Code in conjunction with section 513.34(b) of title 28 of the Code of Federal Regulations. Please treat the instant request in accordance with the above-referenced prior ruling.

We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records.
