Dear Mr. Gonsoulin:

On behalf of the Beaumont Transit Company (the "company"), you ask whether certain information is subject to required public disclosure under the Texas Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 127853.

The company received a request for records reflecting the number of accidents in which vehicles operated by the company were involved for the past two years. You ask whether the company is subject to the Act, and if so, whether the requested information is subject to disclosure.

We recently concluded that the company is a governmental body for purposes of the Act. Open Records Letter No. 99-2498 (1999) (copy enclosed). Thus, the company's records are subject to required public disclosure. You have raised no arguments against the disclosure of the requested information. Therefore, the company must make the information available to the requestor.

We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied on as a previous determination regarding any other records. If you have any questions regarding this ruling, please contact our office.
