You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 130183.
Angelina County (the "county") received a request for "the amount of money Angelina County agreed to have its insurance company pay to keep a sexual harassment and sexual assault lawsuit, filed against the County and Commissioner Jim Risinger, from being made public." We understand you to represent that Angelina County agreed to no payments by its insurance company for the purposes alleged in the request and that the county therefore has no information responsive to the request. Based on your representations, we believe that the county has adequately responded to this request by copying the requestor on its September 30, 1999 letter to this office explaining the county's position. See Open Records Decision No. 362 (1983) (Public Information Act does not require governmental body to make available information that does not exist).
We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records.
