Dear Ms. Ponder:
You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 129583.
The General Services Commission (the "commission") received a request for "the entire file for Bid Requisition No 9-8605-R." You assert no position regarding any exception to disclosure that may apply to the responsive information. You indicate that the interests of a third party, Medela, Inc., are implicated by the release of this information. You indicate that those interests may be protected by sections 552.101 or 552.110 of the Government Code. You inform this office that you have notified Medela, Inc. of the request for information, and of its opportunity to present argument as to why the information should be withheld. Medela, Inc. has not provided comments to this office. As no exceptions to the release of this information have been argued or established, the information must be released. See Gov't Code 552.110; Open Records Decision Nos. 639 at 4 (1995), 552 at 5 (1990), 542 at 3 (1990).
We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records.
