Dear Ms. Roberts:

You ask this office to reconsider Open Records Letter No. 99-3032 (1999). Your request was assigned ID# 131009.

The Seventy-sixth Legislature amended section 552.301 of the Public Information Act (the "act") to provide that a governmental body is prohibited from asking for a reconsideration of the attorney general's decision. Gov't Code 552.301(f). Although the governmental body has not asked us to reconsider the decision in this instance, we similarly decline your request to reconsider Open Records Letter No. 99-3032.

We note that you state that the litigation has concluded. Section 552.103 of the Government Code is temporal in nature. Section 552.103 is not applicable once the litigation has concluded. Therefore, you may wish to submit a new request for the information to Harris County.

If you have any questions regarding this letter, please contact our Open Government Hotline at (877) 673-6839.
