If you’re a crime victim needing an attorney to help with your Crime Victims’ Compensation (CVC) application, we may be able to help cover the cost of their fees. Here’s what you need to know:
You don’t need a lawyer to apply for CVC compensation—these steps are designed to be straightforward, and we’re here to guide you. That said, you have the right to legal help at any time, and having a lawyer can be especially helpful in situations involving:
- Complex medical evidence
- Multiple denied claims
- Appeals
- Large compensation amounts
- Complicated eligibility issues
We cannot cover attorney’s fees for matters like child custody, divorce, immigration, or criminal cases. Additionally, fees for filing lawsuits or seeking damages in civil court are not covered.
Who Can Get Help?
You may receive compensation if you hire an attorney to help with the CVC application process.
How Much Can the CVC Program Cover?
Attorney’s Fees may only be paid if other compensation is received. The limits on those fees are as follows:
- Up to $300 or 25% of the compensation awarded, whichever is less. An attorney is not allowed to ask for or receive more in fees than this amount.
- On appeal, the attorney may collect 25% of the compensation received for their help.
Compensation for Attorney’s fees are separate from the victim’s compensation.
How Do I Receive Assistance?
- Apply for the Crime Victims’ Compensation Program: Apply online or by mail. We'll guide you through each step.
- Get Notified of Eligibility: If your application is approved, you'll receive paperwork confirming your claim and explaining the next steps.
- Decide if You Need an Attorney: You don’t have to hire an attorney to apply for the CVC Program, but you may want help with the process. If you're unsure, consider whether you need legal advice or assistance with gathering the necessary paperwork.
- Find an Attorney: If you decide to hire an attorney, choose one who specializes in crime victims’ compensation claims. Make sure they are experienced in helping victims through the CVC process and understand the program’s requirements.
- Provide Proof of Attorney’s Fees: You’ll need to submit documents showing the attorney’s fees you paid for the CVC application process. Be ready to submit:
- Letter of Representation from your attorney
- Attorney’s Statement Regarding Fees form (sent by your case manager)
- Itemized bills or receipts showing the attorney’s fees
